Pleading down a ticket?
I usually get a lawyer, but this time I can't afford one so I'm going in on my own. Anyone know the procedure for pleading down a ticket in court? I have a 1180D , which Im guessing is the speeding code. I was doing 81 in a 65. Any advice for getting this down to parking on pavement?

I got hit with a 90-sumthin in a 65 on I-90 going to Albany over the summer.
Got it reduced to a 74 in a 65 (under 10mph!!) which is chump change.
AND it was all done by mail, never had to go to court. - First things first, if the court date is less than a month, ASK FOR A CONTINUANCE! This has many, many advantages. It pushes back your court date, you can do this for months, just simply ask, call the court. This give you plenty of time to get everything you need together.
- ASK if you can do it by mail, say you'll be in Florida. It's a hit and miss, some courts simply do not allow it. IF they say no, the continuance will come in handy when the court date does happen. More than half of the cases that are dropped are due to the cop not showing up, the further back you push the court date, the less likely they are to show up, thus getting dropped. (This is not guaranteed though!!!!!!!)
- Obtain your driving record, $10 at the dmv, IF you have a decent record, This will reflect driver responsibility
- Obtain mailing address to the local district attorney ( when you call to see if you can do it by mail, chances are they'll give you the info, if not, ask then, they have it)
- Fax the ticket to the court with "not guilty" checked off so they know your case
- From here, write your case, A absolute must: State the yuou believe the device used to caculate your speed was inaccurate, faulty and/or improperly used by the offer. Simply stating that will cause the court to spend countless hours investigating it IF they want to prove otherwise. They wont, and IF they do, by no means will you get in trouble, by law if they want to fight your judgement, they have to follow protocols that will take up too much time for a simple traffic violation. I included the fact that he pulled me over in the right lane close to an on ramp, and that I was forced to slow down because of the oncoming traffic, thus I couldnt have been going that fast. Make note of you (hopefully good) driving history, and attatch your driving record.

Typically they pull your driving record before accepting plea. They want to know what to offer you. Chances are that if you have DUIs and speeding tickets already (any moving violation), they won't do muich for you.

yeah the trooper cant do anything anymore everyone talks to the da though on your court day. he will have your abstract (driving record) in front of him and you can either take the deal or ask for a trial. It depends a lot on your record.
